Blackstone’s Effort To Secure Seats On NiSource Board Violates Anti-Trust Law

Today in Federal Energy Regulatory Commission docket EC23-99, Public Citizen and Citizens Action Coalition allege that allowing executives from the private equity giant Blackstone to serve simultaneously on the board of directors of NiSource and FirstEnergy appears to violate Section 8 of the Clayton Act, and therefore violates the public interest. The Commission should compel Blackstone to provide a full list of all companies where Blackstone executives serve on the board of directors to assess whether the proposed transaction is consistent with the public interest and with federal anti-trust statutes.
