Ban on Forced Arbitration in Sexual Assault, Harassment Cases Ready for Biden’s Signature
WASHINGTON, D.C. – The U.S. Senate today passed the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (S. 2342), which bans forced arbitration clauses in disputes involving sexual assault and sexual harassment. The U.S. House on Monday passed the bill overwhelmingly by a vote of 335-97. The bill now goes to President Joe Biden for his signature. Remington A. “Corporate apologists for forced arbitration clauses often say it is an alternative venue to obtain justice. But in practice, it has become a venue to insulate bad actors from transparency and accountability. Forced arbitration is bad across the board, but particularly pernicious when used to protect perpetrators of sexual assault and the companies that shield such conduct. As this bill heads to the president’s desk, we applaud the change it will bring.”
